36. From statements by Mr. Shepherd, Mr Stephens, the landlord, and the Stead Bailiff, I am able to report as follows:-
In order not to sacrifice the goods by public auction the creditors passed a resolution, that the debtor should be manager for a quarantee. Mr Shepherd asked the Bailiff to separate the stock, keeping sufficient for the rent and allowing the debtor the remainder, to carry on the business.
After examining the stock the Bailiff informed him, that he would probably require the whole of the stock to meet the distraint. After some discussion, the creditors being very anxious that the stock should not be sold by auction, until, after as much as possible had been realized under Mr. Lang's management; made an arrangement with the landlord, by which the sale by auction under the distress was stayed, on condition, that no sums received by Mr Lang as Manager, should be paid to the estate or to Mr Shepherd without the guarantee.
